Many of our clients are distressed and traumatized immediately after their arrest(s). Some will take the paperwork given to them at the time of arrest, put it aside and say, "I'll deal with it later." Or, will have the attitude of "I just want to get it over with" and not try to present a legal defense to the charges or file appeals to keep his or her driving record clear. Both of these approaches, we believe, are mistaken, because a DWI or DUI can stay on your driving record for life.
If you or someone you know has be charged with DWI or DUI it is very important to see a DWI attorney immediately after the arrest. Time is of the essence. It is important to carefully review the tickets and any other paperwork that was given at the time of the arrest. It is important to follow any instructions contained in these documents so as to avoid automatic suspension/revocation of the driver's license. Failure to take action and file this paperwork in a timely fashion will result in the automatic suspension and/or revocation of the driver's license.
After the necessary preliminary paperwork is filed, we will request that the state or municipality produce all the evidence (police reports, witness statements, video, etc.) that they will use in the prosecution of our clients. We then review this information and look for weaknesses in the state or municipality's case. The question is: can the state or municipality prove its cases against our client? Can we achieve an acquittal if the case goes to trial? Can we keep the client's driving record clear?
If, after we have reviewed all of the evidence that we expect the state or municipality will present, we confer with our clients. We answer any questions that they may have. We help with them weigh the pros and cons of the decision they must make: to go to trial or enter into a plea bargain. Every individual faces different obstacles when making these decisions. Some can't take a conviction at all or they'll lose their jobs. Some people have prior convictions and will face jail time if they're convicted again. Some acknowledge that they've made a mistake that they will never repeat and want to get through with it without wasting a lot of time and/or money.
In almost all DWI / DUI cases the courts utilize various tools and programs such as probation, substance abuse education programs, ignition interlock devices, and community service programs. If a client fails to follow the orders of the court with respect to the attendance of these programs, the client may lose the result of any negotiated plea or may delay the reinstatement of his or her license. Because we have handled, literally, thousands and thousands of DWI cases our staff is quite familiar with all of these programs and can give our clients quick answers to any of their questions.
